If we discover proof of reckless lending, we’ll go to the court on your behalf and have them create an order declaring the contract in question as a reckless credit agreement. In which case, we could have all or some of your financial obligations (debts) under the agreement suspended or even set aside altogether (written off).
When you apply for a loan, your credit provider is legally required to conduct an affordability assessment, to see if you can afford to pay it back in the required monthly instalments within the agreed upon term.
If you are struggling to maintain your monthly repayments, this could be a sign that your credit provider failed to do a thorough credit check before granting you credit, or that they dismissed the fact that you aren't financially equipped to pay it back, even after assessing your circumstances, yet approved you for the loan anyway.
