General Terms and Conditions To Buy or Sell at our public Auction
Our terms and conditions are established to ensure that all of our customers can transact business in a professional manner. We hope your experience is a positive one here at HammerDown Auctions.
HammerDown Auctions reserves the right to interpret ALL terms and conditions and to decide all issues of dispute. HammerDown Auctions reserves the right to refuse anyone the use of its services.
HammerDown Auctions assumes NO responsibility for theft, fire, loss of equipment left in vehicle or damage to any vehicle left at Auction site. State and local police are authorized to inspect vehicles as needed.
**NO ONE under the age of 16, will be allowed in the Auction arena.
** Must be 19 yrs of age or older to purchase a vehicle
** Title must be in seller's name free and clear of any leans
ALL VEHICLE'S WILL HAVE A BUYER'S FEE ADDED TO PURCHASE PRICE........
Vehicles not eligible for sale at auction:
• V.I.N. plate that has been removed or altered
• Vehicles without clear titles
• Grey Market vehicles not meeting U.S. Standards
• Vehicles without at least two points of identification or serial number plates
HammerDown does NOT guarantee factory warranties.
All of the block sales must be approved by Dealer Representative.
Unless the sale of an article is advertised or announced to be otherwise, each lot is offered subject to the reserve price of the owner/seller. When an article is sold with reserve, the auctioneer may bid on the owner/seller's behalf in an amount not to exceed the reserve price.
PREVIEW DATE & TIME - Vehicles are available for on-site previews from 5pm until 7pm the day before the auction, and from 8am-9:30pm day of auction.
CHECK OUT DATE & TIME - During normal business hours 9am-5pm Monday – Friday
REGISTRATION - Public buyers must register in the office and obtain a bidder badge in order to bid at the auction and enter the secured lot. Public registration opens at 12pm on the day before sale day.
INSPECTION - Public Inspection opens Friday at 5pm-7pm. Buyers are encouraged to inspect vehicles prior to the sale and are welcomed to bring along a mechanic. Buyers are responsible to ensure that they are aware of the price the auctioneer is offering, the sale price of a vehicle is not subject to arbitration.
OUTSIDE SALES - All vehicles purchased must be paid for through the auction office, even if bought directly from the seller away from the auction block. All vehicles purchased directly from the seller away from the auction block are sold "AS IS" and are not subject to arbitration for any reason. Sellers engaging in direct sales away from the auction block will not receive a check until the vehicle has been paid for in full.
LATE ENTRY - Vehicles registered late WILL be run NEXT AUCTION. To avoid this inconvenience, please register vehicles prior to the auction start time. Registration ends 12pm NOON the Thursday before auction.

SPECIAL TERMS FOR INTERNET BUYER'S - By registering as a buyer ('Buyer') with HDA you agree to be bound by the following terms and conditions. HDA reserves the right to amend these terms and conditions at any time without prior notice to the Buyer. Terms and conditions printed on auction lists, announced at the live auctions and displayed on HDA's Website at www.HammerDownauctions-Omaha.com become part of this agreement by reference. All vehicles are sold AS IS, unless otherwise noted according to our lighting system. All 'AS IS' sales are final – no exceptions. All winning bidders must secure a $300.00 minimum deposit immediately upon winning the lot. Final balances must be paid in full by 4pm on the Monday immediately following the auction. If final payment is not made by this time, all monies deposited will be lost and all rights to the purchased vehicle or property are waived. All purchased vehicles and property must be PAID IN FULL prior to their release. Violators will be prosecuted to the fullest extent of the law. Account Responsibility – Buyers are responsible for all transactions on their account, including, without limitation, all live bids places by authorized bidders and bids submitted through Proxibid using the log in name and password issued to the Buyer. Accounts cannot be transferred. In the event of unauthorized use of Buyer's ID card or log in information, buyer shall be responsible for all charges incurred prior to receipt of written notice by HDA advising of such unauthorized use. Membership Cancellation – HDA reserves the right to suspend or revoke the buying privileges of a Buyer for any reason. Auction Cancellation – HDA may, at anytime, in its sole and absolute discretion and with or without notice, postpone or cancel a sale. HDA will neither be liable or obligated to the Buyer as a result of any auction postponement or cancellation. Vehicle Withdrawal – HDA reserves the right to withdraw from auction any vehicle for any reason at any time at its sole and absolute discretion. Tie Bid Policy – Should a tie occur between an online bid and a bidder attending the live auction, the live bidder will be awarded the vehicle. Reserves – Due to the wide variety of vehicle sources, some vehicles may have a minimum amount, or reserve, set by the vehicle provider. If a vehicle has a reserve designated by the vehicle provider, HDA reserves the right to PASS the vehicle on behalf of the vehicle provider. Vehicles sold on IF – Vehicles requiring the approval by the approval by the vehicle provider will not be released to Buyers until bid is accepted by the vehicle provider. Vehicles sold in such a matter will be announced as 'SOLD ON IF'. All vehicles sold on a 'IF' lock you into that bid until 9am the following day. We try our hardest to notify you if your bid has been accepted by the seller by the end of the auction. Seller has the right to accept, deny, or counter your bid. If the seller accepts your bid, you OWN the vehicle for your bid price plus the appropriate fees. If you have won multiple vehicles on a 'IF” and all bids are accepted by sellers, YOU have purchased ALL of those vehicles. If there is a counter bid from seller you may accept, deny, or counter the seller's offer. Bid Rejection – HDA reserves the right to reject or void bids at anytime for any reason. Should a dispute arise regarding a bid, HDA is the single deciding authority with sole and absolute discretion in resolving disputes. Buyers agree to indemnify, defend and hold harmless HDA from any and all liability arising from decisions made resolving disputes. HDA does not offer any guarantee or warranty for mechanical condition, body condition, warranty, salvage title, VIN numbers, year, make, model, mileage, or equipment. We encourage all buyers to inspect vehicles prior to bidding and purchase. All descriptions are made by observation only and are not guaranteed by HDA. All winning bidders must make a minimum $300.00 deposit immediately upon winning a lot and the remaining balance is due by 4pm on the Monday following the auction (See deposit info on-site). If final payment is not made by this time, all deposited monies will be lost and all rights to the purchased vehicle or property will be waived. All purchased vehicles and property must be paid in full prior to their release. HDA is not responsible for vehicles left on the premises upon conclusion of the auction. Vehicles not removed from the auction premises by 5pm on the Friday following the auction may be assessed a $10 per day storage fee. Unless arrangements have been made.
PAYMENT POLICY - ALL vehicles must be paid for on the day of the sale or by the following Monday by 4:00PM. Failure to pay within this time frame, will result in a late fee of $100 per unit. Payment types: Cash or Credit cards (with a convenience charge of 4%). DEALERS ONLY - Checks will be accepted (Returned checks will be charged $50.00 per item. ALL return checks need to be satisfied within 24 hours of notification. SELLER checks will be issued the day following the next business day after the auction. A completion of a IRS 8300 form will be required for ALL cash purchases over $10,000.
