Elder Law is relatively new in the Commonwealth. Perhaps for this reason and a few others, there is a lot of misinformation and surprisingly bad advice that sometimes comes from professionals be they bankers, financial planners, accountants, or –gasp- attorneys when it comes to advising the elderly who might someday need a Nursing Home. This is driven by lack of knowledge of this emerging field. Advice that is often prudent for gift, estate, and tax purposes may be the wrong thing to do for ordinary older folks with non-taxable estates and issues relating to long term care, nursing homes, Medicaid potential, guardianships and tangential matters.
Nothing says an elderly person who has worked hard and played by the rules all his or her life should have to leave the world destitute, with limited support for his or her spouse, and no legacy for his or her children because of the need for nursing home care. Because our legal focus is narrowly tailored to the specific documentary and planning needs of the elderly, we are able to leave our clients and their children well positioned to preserve assets and equipped to deal with difficult end of life decisions. We also assist our clients and their families with the probate process.
Our initial interview typically takes an hour and a half and is provided free of charge. It is filled with practical tips and legal advice for the elderly and their families. If you refer a client to us, please feel free to attend the initial interview and any subsequent meeting yourself (with client approval). We encourage the attendance of family members, friends, and religious, financial, or legal advisors.
Our office is located in St. Mathews, right off Breckinridge Lane. (We are down the road from W.W. Cousins Restaurant and located in the same building as Borders & Borders, PLC) We have plenty of parking, handicapped access, and we have a wheelchair if needed.
