Brian M. Fishman is a Philadelphia trial lawyer. He has been practicing for over 12 years and his primary focus is on the defense of individuals charged with criminal offenses. He also represents those injured by the negligence of others in car accidents and premise liability cases, those served to appear in Philadelphia Family Court for Protection from Abuse Orders, custody, support or divorce cases and those wrongfully accused of criminal offenses or victims of police brutality or excessive force by law enforcement. Mr. Fishman practices in Philadelphia, Montgomery, Delaware, Bucks and Chester Counties. From 2001-2005, he was an Assistant District Attorney in the Philadelphia District Attorney's Office. He prosecuted thousands of criminal cases and served in the elite Family Violence & Sexual Assault Unit where he prosecuted those charges with rape, sexual assault, involuntary deviate sexual assault, possession of child pornography, child abuse and domestic violence. From 2005-2013, Mr. Fishman worked in private practice as an associate at David S. Nenner & Associates. For over 8 years, he defended individuals charged with criminal offenses including narcotics charges, firearm offenses, robbery, burglary, rape, fraud, theft, DUI and all other criminal charges. He has tried over 40 jury trials to verdict and thousands of bench or waiver trials. In addition, he has dealt with every aspect of a criminal case from arraignment, bail hearings, preliminary hearings, Nebbia motions, motions to quash, motions to suppress, trial, post-verdict motions, post-sentence motions, appeals to both the Pennsylvania Superior and Supreme Court, oral argument before the Superior Court and PCRA (Post-Conviction Relief Act) Petitions. His experience as both a prosecutor and criminal defense attorney has gained the attention of fellow attorneys, judges and court staff as he has twice been named a Pennsylvania Super Lawyers Rising Star in the area of Criminal Defense in 2010 and 2013.
