Credit Default Swap Enhancement
This product is an addendum to the securitization audit that will allow your client to know if a Credit Default Swap (CDS) existed on their securitized mortgage loan. This product has proven itself to be an invaluable tool in the courtroom in that it can create ambiguity relating to the note being paid and satisfied in full. It also offers critical evidence far beyond what forensic mortgage auditing provides.
What this means is that by using the CDS enhancement to illustrate that the note was possibly paid in full by a third party, your client’s obligation to pay their mortgage in full as part of the foreclosure process is now in question. For a foreclosure defense attorney, this type of evidence and ambiguity is extremely helpful in developing a successful case strategy.
