Wills, Trusts & Power of Attorney
Rebecca Mason Law, LLC, counsels clients through the process of estate planning. Whether it is working with you to draft your will or to create a trust, Attorney Mason will provide you with an estate plan tailored to meet your specific needs.
We also work with clients to create one of the most important advance planning documents: your Health Care Power of Attorney / Living Will. You have the right to decide what medical treatment you will receive, and what medical treatment you will refuse, based on your personal system of values. This document will allow you to designate who will make decisions if you cannot, and will give your loved ones peace of mind that they are following your wishes. Having a valid and comprehensive Health Care Power of Attorney also can eliminate the need for a guardianship or protective placement order -- which can be costly and time-consuming, and puts a judge in the position of making decisions for you.
In addition, we are able to counsel you about the need and process for establishing a Power of Attorney for Finances & Property. Designating a Power of Attorney enables you to appoint an agent to assist you with managing your finances and property if you are unable to do so. This Power of Attorney document also can alleviate the need for a guardianship.

Probate & Trust Administration
Probate is a court-supervised process used to transfer assets and pay debts. When a loved one dies, it is common to wonder if probate will be necessary and, if so, how long it will take and how much it will cost. Rebecca Mason Law, LLC, can help guide you through the process.
If the assets of your loved one were owned through a well-drafted and properly funded trust, it is unlikely that court-managed administration is necessary. As designated by the trust, the successor trustee will need to administer the distribution of the deceased's assets.
Whether probate is necessary depends on a variety of factors, including the size of the estate, the existence of a trust or valid will, accounts with a pay on death (or POD) beneficiary designations, and ownership of real estate. Wisconsin law allows for informal and formal probate. Probate typically takes about one year, and the costs (attorney fees, personal representative fees, publication and filing fees) vary depending on the size and complexity of the estate, and whether the beneficiaries are in agreement.
