Currently, I am promoting a recent change in Indiana law where if you have had a case dismissed by a pretrial diversion you can petition the court to have you record restricted to access by the public.
This is a valuable tool is keeping others who are not members the criminal justice community, especially employers from seeing that you once had, say, a PI (public intoxication), or you once got caught for illegal possession of alcohol before you were twenty one years old.
Once you get a Court ORDER limiting public access, you are allowed by statute and the current law to say on your application, that you do have that arrest or charge on your record.
In other words, let me provide you with an example.
Say you were living in Bloomington and as an IU student, you got charged with possession of marijuana as a misdemeanor.
You were offered a diversion program by the prosecutor's office where you paid a fee, approximately 400 dollars, took a drug class, and agreed not to get in any trouble for a year.
Once you complete this agreement, your case is dismissed, BUT it can still be found online and anyone looking for a job can find it. Go to http://mycase.in.gov/default.aspx and see for yourself.
ANYONE can find this.
However, if you qualify I can petition the Court to limit the public access to this.
WHAT IF I HAVE A FELONY?
The law is a little different.
Your felony must not be a crime of violence or a sex crime, and if it is 8 years AFTER you have completed your sentence and/or probation and other conditions apply, I can limit public access to this record as well.
This is a tremendous benefit to folks who are having trouble getting a job because of a prior felony.
Again, once the Court issue the ORDER, you do not have to mention this conviction.
This new law, about a year old, is BIG BIG BIG!!
