Description

Rules & Regulations of the Westview Cemetery Association are as follows:

All lots in the Westview Cemetery are sold in accordance with the provision of the laws of the State of New York and shall not be used for any other purposes than as a burial place for a dead human being.

No interment shall be allowed without permission being first obtained from the Westview Cemetery Association. At the time of applying for permission, the following information must be furnished:
1. Name of deceased.
2. Age of deceased-including date of birth, if known.
3. Place of birth of deceased, if known.
4. Date of death.
5. Time and date of interment.
6. If not an adult-the names of parent(s) or legal Guardian(s) of deceased.
7. Need to find if deceased is a Veteran and what time served in the Military.

Lot owners are prohibited from allowing interments to be made on their plots for compensation.

Interments in a plot are restricted to those entitled to burial therein according to the terms of Section 1512 of the Not-For-Profit Corporation Law. Permission for burial of those not entitled to burial according to said section, must be filed with the Westview Cemetery Association by the plot owner(s).

Except as provided for the Section 1513 (c) of the Not-For-Profit Corporation Law, no plot owner may transfer his or her plot.

The full purchase price must be paid before a deed will be given or burial allowed on the plot.

The Westview Cemetery Association reserves the right to remove all flowers, wreaths or other decorations from the plot as soon as they become unsightly.

The Westview Cemetery Association reserves the right to remove, after due notice to the plot owner, any embellishment on the plot, effigy or inscription which, in the opinion of the majority of the trustees or directors, is unsightly or dangerous.

The Westview Cemetery Association reserves the right to restrict the planting of shrubs and trees and to remove any shrubs or trees deemed dangerous to the public, upon due notice to the plot owner.

Funerals must be at the cemetery between 10:00 a.m. and 3:00 p.m. in order that the grave opener will have sufficient time to properly close the grave and remove the equipment by 4:30 p.m. Also need to have notice of the funeral and type of burial.

No monuments or markers shall be permitted which utilize colors other than those of natural stone.

Placing of glass blocks or vases as receptacles for flowers, either artificial or grown, on graves or plots, is prohibited.

All foundations will be to the specification of the Westview Cemetery Association.

Only one monument or marker shall be allowed on a plot and it shall be set in accordance with the general plan of the cemetery and shall conform to said plan in size and material.

Monuments are restricted in size to dimensions, which will not cover more than 75% of the surface area of the plot. Every monument shall be at least 10 inches in thickness.

The bases of all monuments shall be finished true and level so as to fit on al foundations without wedging or sprawls.

No monument will be allowed to be delivered in the cemetery until the foundation is installed, (which is not the responsibility of the Westview Cemetery Association) and ready to receive the monument.

Heavy trucking or other vehicular traffic shall be refused entrance to the cemetery when, in the opinion of the President or Vice President, injury to the roads and driveways might result.

All persons shall be allowed access to the cemetery during daylight hours, observing the rules, which are in effect and the propriety due the cemetery.

All monuments or markers must be constructed of granite or bronze.

Disinterment's will be allowed between May 15th and October 15th provided there is compliance with all provisions o Section 1510(e) of the Not-For-Profit Corporation Law.

The Westview Cemetery will govern interments on Sundays and Holidays.

Graves will not be opened between October and May, when frost and weather conditions warrant such refusal. Bodies received for interment during this time will be placed in a vault until spring.

Created remains will not be permitted to be scattered in any part of the cemetery.

Concrete vaults or concrete grave liners will be required for interments in all graves purchased on or after December 20, 2001, in accordance with the provisions of the Westview Cemetery Association. This includes cremations.

As of January 1, 2008, the Westview Cemetery Board Officers have voted on changing the number of interments per grave. As previously stated on January 2, 2002, Rules & Regulations, there could be one adult casket and/or one youth size casket per grave or four cremations per grave or one adult casket with one cremation per grave. There will now be one interment per grave which cost $125.

There can be one upright monument or marker on a plot for a cremation; the other ones will have to be flat to the ground markers.

The directors of said Westview Cemetery Association may amend these rules and regulations, but no such amendments shall be effective until approved by the New York State Cemetery Board.
