GENERAL TERMS AND CONDITIONS:
Information on how to enter and the prize to be won form part of these Terms and Conditions. Participation in this Competition is deemed acceptance of these Terms and Conditions.
The promoters of this Competition are New Balance SA PTY (Ltd) registration number: 1999/021/414/07 (the "promoters")
These terms and conditions are governed by the Consumer Protection Act 68 of 2008.
ENTRY MECHANICS:
This Competition will run from 16 – 22 April 2016. The closing date for the Competition is on 22 April at midnight. No late entries will be considered.
To participate in the Competition, entrants must screengrab the Concepts x New Balance Colab image in the competition GIF. Once they have screen grabbed it they need to upload the image to their personal Instagram page and tag @newbalanceza and @Xtrendstore
Entrants will only be allowed one entry. Multiple entries are not recorded.
The Prize winner will be drawn by New Balance on Friday 22nd April 2016.
The winner of the Prize will be notified by social media, Istagram within 2 working days of the draw. If the winner fails to claim their Prize within 7 days of receiving such notification from the Promoters, he/she will forfeit their Prize.
You will be required to visit the Xtrend Store in Braamfontein to collect your prize. Should the winner size no longer be available when they collect their prize they shall be allocated by New Balance South Africa product and apparel to the prize value of R5499.95
The Competition is only open to South African residents aged 18 years or over.
The Competition excludes directors, employees or agents of the Promoters and their families, affiliated companies, and public relations and advertising agencies of the Promoters or any other person who directly or indirectly controls or is controlled by the Promoters or a supplier of goods or services in connection with the Competition.
New Balance will not be responsible for any other expenses which the winner may incur as a result of their acceptance and/ or use of a prize, whether foreseen or not.
New Balance reserves the right to vary, postpone, suspend, or cancel the competition and any prize (which have not yet been subject to a draw), or any aspect thereof, without notice at any time, for any reason which New Balance reasonably deems necessary.
If the winner fails to comply with any of these rules or the terms of acceptance of the prize, the winner will be automatically disqualified and will forfeit the prize.
The Promoters reserve the right in their sole discretion to disqualify any individual who the Promoters have reason to believe has breached any of these Terms & Conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardize the fair and proper conduct of the Competition. The Promoters legal rights to recover damages or other compensation from such an offender are reserved.
The Promoters reserve the right to request the winner to provide proof of age, identity, proof of residency at the nominated prize delivery address, and/or proof of entry validity. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoters. The Promoters reserve the right to validate and check the authenticity of any prize claim or entry before awarding a prize.
The winner accepts any prize allocated to him/her at own risk. Neither the Promoters, nor any of its sponsors, affiliates and agencies, nor their employees, accept any liability for:
Any oversight, ambiguity, error or omission, whether negligent or otherwise, which any of its employees, agents, affiliates or sponsors may commit in the running of the Competition and the awarding of the prize.
Injuries, losses or damage sustained as a result of the use of any Prize or participation in the Competition.
Any violation or attempt to violate any of the above rules and conditions will result in the immediate disqualification of any transgressing entrant and may result in promoters being entitled to reclaim the prize from a winner.
DISCLAIMER:
If for any reason the Competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoters, which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition, the Promoters reserve the right in their sole discretion to cancel the Competition and recommence it from the start on the same or similar terms and conditions as these.
Where relevant, if a person does not accept the Prize within the term specified, if an entry is not valid for whatever reason, if an entrant has breached these terms and conditions, if a person renounces the Prize or we deem such person to have renounced the Prize, we reserve the right to declare the Prize forfeited and/or choose a new Prize winner.
In the event of any dispute regarding the Rules, conduct, results and all other matters relating to a Competition, the decision of New Balance SA shall be final and no correspondence or discussion shall be entered into.
INTELLECTUAL PROPERTY RIGHTS & USE OF ENTRIES
The winner hereby assign to the Promoters all rights, title and interest in and to all Intellectual Property including copyright, in any material created pursuant to the winner’s participation in any aspect of the prize including the winner’s image. The winner acknowledges that the Promoters are free to use such copyright including but not limited to any images, photographs, videos, winner comments or remarks whether written, audio or visual and to exercise their rights in relation thereto (including advertising or marketing thereof, in any media whatsoever throughout the world) and the winner will not be entitled to any fee for such use.
Data relating to entrants will be retained by New Balance SA for a reasonable period after the Competition closes to assist New Balance SA to operate competitions in a consistent manner and to deal with any queries on the Competition.
JURISDICTION
The Competition and Rules will be governed by the laws of the Republic of South Africa and any disputes will be subject to the exclusive jurisdiction of the courts of the Republic of South Africa. The Sites are only intended to be accessed from the Republic of South Africa.
New Balance SA makes no representation that materials on the Site relating to this Competition are appropriate or available for use at other locations and access to them from territories where their contents are illegal is strictly prohibited. If you access the Site outside of the Republic of South Africa, you are responsible for compliance with all local laws.
If required by the Minister of Trade and Industry, the National Consumer Commission or for whatever other reason, we will have the right to terminate this Competition with immediate effect and without notice of such termination. In such event, all entrants hereby waive any rights, which they may have against us and hereby acknowledge that they will have no recourse or claim of any nature whatsoever against us.
Entrants agree that these conditions are reasonable to ensure the integrity of the Competition and its fairness to all other entrants.
