ORDINANCE NO. 2018-12
SHORT TITLE:
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF DECATUR, INDIANA, (“CITY”) WHICH ESTABLISHES THE PROPER USE OF THE CITY'S SOCIAL MEDIA SITES, WHICH PROHIBITS CERTAIN USES AND WHICH ESTABLISHES THE RIGHTS OF THE CITY TO MONITOR AND ADMINISTER ITS SOCIAL MEDIA SITES.
Section 3. Prohibited Uses. The following comments shall be considered prohibited posts or comments on the City's social media sites:
- Comments unrelated to the purpose and topical scope of the page.
- Obscenities.
- Personal identifying information or sensitive personal information.
- Incitement to lawless action.
- Speech presenting a grave and imminent threat.
- Fighting words.
- True threats.
- Fraud.
- Defamation (libel/slander).
- Solicitations to commit, or speech integral to, criminal conduct.
- Information that could reasonably compromise public safety.
- Promotion or advertisement in favor of, or in opposition to, a political campaign or candidate.
- Apparent spam.
- Content posted by automatic software programs (i.e. “Bots”).
- Information which may interfere or compromise current investigations, police tactics, or the safety of police staff and officers.
- Copyrighted material (if posted without the copyright holder's consent).
Section 4. Notification of Removal. In the event the City takes steps to remove a post or comment, the moderator of the City's social media sites shall notify the user by social media messenger that the post or comment was removed by the City and state the reason(s) why the post or comment removed was determined to be a prohibited post or comment.
