He graduated cum laude from Harvard Law School in 2001, and clerked for Judge James B. Loken on the United States Court of Appeals for the Eighth Circuit following graduation.
Antitrust: Mr. Bona represents global clients in a wide variety of antitrust matters, including issues arising from intellectual property disputes or settlements, agreements among competitors, loyalty discount and other exclusionary conduct issues, merger and acquisition transactions, resale-price maintenance programs, Noerr-Pennington issues, state-action immunity issues, labor-exemption issues, Robinson-Patman Act issues and government investigations. Mr. Bona has also developed a global antitrust and competition policy for an international trade association, and advises standard-setting organizations on antitrust issues.
Appeals: Mr. Bona has argued appeals in both state and federal courts, and has filed many amicus briefs, including a recent brief with the United States Supreme Court in FTC v. Phoebe Putney Health System, Inc., arguing that a market-participation exception should apply to state-action immunity from the antitrust laws.
Business Litigation: Mr. Bona has experience with many types of disputes that can arise for businesses, including, for example, claims involving trade secrets, breach of contract, fraud and misrepresentation, tortious interference, malicious prosecution, RICO, unfair and deceptive trade practices, intellectual property, securities, procurement disputes and other state and federal claims.
Challenges to Government Conduct: Many of Mr. Bona’s cases, at both the trial and appellate level, involve challenges to government conduct in some form or another. He is personally trying to move the direction of law—through both cases and public advocacy—to allow businesses greater opportunity to utilize the antitrust laws against state and local governments when the government itself is harming competition.
